1. Agreement to these terms

These Terms of Service ("Terms") govern your access to and use of DMAGNT — the website at dmagnt.com, the dashboard, the Telegram channels, and anything else we publish under that name (together, the "Service").

By creating an account, or by using the Service in any way, you agree to these Terms. If you do not agree, do not use the Service.

Not reading them does not exempt you from them. They are written in plain language on purpose so that reading them takes a few minutes.

You must be at least 18 years old and legally able to enter into a contract to use the Service.

2. What DMAGNT is

DMAGNT reads publicly reported options market data and presents what it finds: where open interest and gamma exposure are concentrated, which price levels carry the most weight, where hedging pressure changes sign, and how that picture moves during a trading session.

That is the whole of it. DMAGNT describes positioning — where money currently sits in the options market. Positioning is one force among many acting on a stock price, and news, earnings, macroeconomic events and plain chance will override it without warning.

3. Not financial advice

Nothing on DMAGNT is financial, investment, tax or legal advice. We are not a registered investment adviser, broker-dealer, or financial planner, and nothing we publish should be read as a personal recommendation.

We do not know your financial situation, your goals, your tax position or how much risk you can absorb, and we do not take them into account. No level, signal, alert, score, scenario or commentary on the Service is a suggestion that you should buy, sell, or hold anything.

Before you act on anything you see here, consider speaking with a licensed financial professional who knows your circumstances.

4. No guarantee of results

We make no promise, express or implied, that any level will be reached, that any signal will be correct, or that using the Service will make you money. It may lose you money.

Where we publish measurements of how our own levels performed, those are historical observations over a stated sample and a stated period. They are published so you can judge the Service honestly — including its failures. Past behaviour does not predict future behaviour. A method that worked across one set of sessions can stop working in the next one, and nothing about a past percentage entitles you to expect it again.

Options trading carries substantial risk and is not suitable for every investor. You can lose your entire investment, and with some strategies more than your entire investment. You are responsible for understanding the instruments you trade.

5. Data, sources and accuracy

Market data reaching the Service comes from third-party providers. We do not control it, we did not produce it, and we cannot guarantee that it is accurate, complete, or current.

Data may be delayed, incomplete, revised after the fact, or simply wrong. Calculations derived from it — including magnet levels, walls, flip levels, exposure figures and any score or scenario — inherit every one of those problems. Figures shown on the Service can differ from those shown by your broker or by other platforms, for legitimate reasons of timing, source and method.

Verify anything that matters before you act on it. Do not use the Service as your only source.

6. Availability and interruptions

The Service is provided "as is" and "as available". We do not promise any level of uptime, and we make no service-level commitment.

The Service may be unavailable, slow, partially broken or out of date at any time, including during market hours and including at the exact moment you most need it — because of maintenance, software faults, failures at our hosting or data providers, network problems, or causes outside our control. Alerts and messages may be delayed, duplicated or never delivered.

We may change, suspend or discontinue any part of the Service at any time, with or without notice.

7. Your account

You need an account to use the dashboard. You agree to give accurate information, to keep your password confidential, and to be responsible for everything done through your account.

Accounts are personal and for one person. Do not share your credentials, and do not let other people use your access. Tell us promptly if you believe someone else has got into your account.

8. Payments, renewals and refunds

DMAGNT is currently free while in beta. When paid plans are introduced, this section governs them, and pricing and billing details will be shown clearly before you are charged.

• Subscriptions renew automatically for the same period until you cancel. You can cancel at any time; the cancellation takes effect at the end of the period you have already paid for.
• Fees already paid are not refundable, including for periods you did not use, for outages or degraded service, for dissatisfaction with the information provided, and for trading losses of any kind. Where applicable law gives you a refund right that cannot be waived, that law prevails over this paragraph.
• Payments are handled by third-party payment processors. We do not receive or store your card details.
• We may change prices. Changes apply from your next renewal, and you will be notified in advance with enough time to cancel if you prefer.
• If a payment fails, access may be suspended until it is resolved.

9. Acceptable use

You agree not to:

• Scrape, crawl, harvest or bulk-extract data from the Service, or access our systems by any automated means we have not authorised.
• Resell, redistribute, republish or commercially exploit the Service or its output, in whole or in part, without our written permission.
• Share, sell or transfer your account, or give access to people who have not agreed to these Terms.
• Attempt to break, overload, probe or bypass the security of the Service, or to reach any part of it you have not been given access to.
• Reverse engineer the Service, or use its output to build a competing product.
• Use the Service to break any law or regulation that applies to you, including securities and market-conduct rules.
• Present the Service's output as your own advice to other people, or in any way that suggests we endorse what you tell them.

10. Ownership

The Service — its software, design, name, logo, written content and the methods behind its calculations — belongs to DMAGNT and is protected by intellectual property law. Your account gives you a personal, non-exclusive, non-transferable, revocable right to use the Service under these Terms, and nothing more.

Underlying market data belongs to its respective providers and exchanges.

11. Third parties

The Service relies on third-party providers for hosting, authentication, market data, messaging and payments. Their failures can become our failures, and we are not liable for them.

Links to other websites are provided for convenience. We do not control them and are not responsible for their content or their practices.

12. Limitation of liability

To the maximum extent permitted by law:

• The Service is provided without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
• We are not liable for any trading loss, lost profit, lost opportunity, lost data, or any indirect, incidental, special, consequential or punitive damages arising from your use of — or inability to use — the Service, even if we were told such damages were possible.
• Where liability cannot be excluded, our total liability to you for all claims is limited to the greater of the amount you actually paid us in the twelve months before the claim arose, or fifty US dollars.

Some jurisdictions do not allow certain exclusions or limitations. Where that is the case, the exclusions above apply only as far as that jurisdiction permits, and the rest of this section stays in force.

13. Indemnification

You agree to defend, indemnify and hold harmless DMAGNT and the people behind it from any claim, loss, liability, cost or expense (including reasonable legal fees) arising from your use of the Service, your breach of these Terms, or your violation of any law or of anyone else's rights.

14. Suspension and termination

You can stop using the Service and close your account at any time.

We may suspend or terminate your access, with or without notice, if you breach these Terms, if we reasonably suspect fraud or abuse, if required by law, or if we discontinue the Service. If we terminate your paid access without cause, we will refund the unused portion of what you have paid.

Sections that by their nature should survive termination — ownership, limitation of liability, indemnification and governing law — survive it.

15. Changes to these terms

We may update these Terms. When we do, we will change the version and date at the top of this page, and for material changes we will give notice through the Service or by email before they take effect.

Continuing to use the Service after a change means you accept the updated Terms. If you do not accept them, stop using the Service and close your account.

16. Governing law

These Terms are governed by the laws of the Commonwealth of Puerto Rico and the applicable federal laws of the United States, without regard to conflict-of-law rules. You agree that the courts located in Puerto Rico have exclusive jurisdiction over any dispute arising from these Terms or the Service.

If any provision of these Terms is found unenforceable, the rest remains in effect.
